Terms of Service

These Terms of Service ("Terms") govern access to and use of Verity at feedback.momand related services (the "Service"). By creating an account, installing the widget, or using the Service, you agree to these Terms.

If you use the Service on behalf of an organization, you represent you have authority to bind it. In that case, "you" means the organization.

1. Who we are

Verity ("Verity", "we", "us") is operated from Norway. Contact: [email protected].

If we reorganize, incorporate, or transfer the business (for example to a Norwegian AS), we may assign these Terms and transfer related agreements and data to a successor entity. We will update these Terms and notices accordingly.

2. Business use only

The Service is intended for use by businesses and teams. You confirm you are using the Service in the course of business (not as a consumer). If mandatory consumer rules apply to you in your jurisdiction, some provisions of these Terms may not apply to the extent prohibited by law.

3. Definitions

  • • Account Data: information related to your account and workspace, such as name, email, billing details, plan info, and security logs.
  • • Customer Content: data you or your end users submit, upload, transmit, or collect through the Service, including feedback reports and evidence (as defined below).
  • • End Users: individuals who submit feedback through your widget or interact with your configured feedback flows.
  • • Evidence: optional diagnostic material that may include screenshots and attachments, session replay data (event-based recordings), technical telemetry (such as console/network diagnostics), annotations, and derived artifacts, as enabled by you.
  • • Integrations: third-party services you connect (e.g., GitHub, Slack, Linear, Jira, webhooks).

4. The Service

Verity provides a feedback widget, an admin triage interface, and optional Integrations (including webhooks). Some processing occurs asynchronously, which can affect timing of evidence processing and delivery.

We may modify the Service over time, including adding, changing, or removing features. We'll aim to provide reasonable notice of material changes that significantly affect paid plans.

5. Accounts, access, and security

You agree to:

  • • provide accurate account information and keep it updated,
  • • keep your credentials secure,
  • • ensure only authorized users have access to your workspace and Integrations.

You are responsible for all activity under your account, including actions taken by your team members and by Integrations you enable or configure.

We may suspend or restrict access to protect the Service, customers, End Users, or third parties, including in cases of suspected compromise, abuse, or security risk.

6. Acceptable use

You will not (and will not allow others to):

  • • use the Service for unlawful, harmful, abusive, or fraudulent purposes,
  • • attempt to bypass security controls, probe vulnerabilities, or access other customers' data,
  • • disrupt the Service (including malware, automated abuse, or denial-of-service),
  • • submit or collect content that infringes intellectual property or violates privacy/data protection laws,
  • • use the Service to collect highly sensitive personal data unless you have a lawful basis and the Service is configured and documented to support it.

You must use Integrations responsibly and comply with third-party terms. You are responsible for your configuration choices (including webhook destinations and access permissions).

7. Customer Content and Evidence

7.1 Ownership. You retain ownership of Customer Content.

7.2 License to operate. You grant Verity a limited, non-exclusive license to host, copy, process, transmit, and display Customer Content only as necessary to:

  • • provide and secure the Service,
  • • perform evidence processing (including generation of derived artifacts such as screenshots/annotated variants when enabled),
  • • operate enabled Integrations and webhooks,
  • • prevent abuse and maintain reliability.

7.3 Your responsibilities and lawful basis. You are responsible for:

  • • ensuring you have all rights and a lawful basis to collect and submit Customer Content (including Evidence),
  • • providing any required notices to End Users (including consent/cookie/recording notices where required),
  • • configuring what Evidence is collected, and ensuring collection matches your policies and legal obligations.

Important: Features like session replay and technical telemetry may require providing notice to End Users and obtaining consent depending on jurisdiction and your configuration. You are responsible for enabling these features appropriately and ensuring you have a lawful basis to collect and process such data.

7.4 Removal. We may remove or restrict Customer Content if we reasonably believe it violates these Terms or law, or creates risk to the Service or others.

8. Privacy and data protection

Our Privacy Policy explains how we process personal data.

8.1 Roles (controller/processor).

  • • When you use Verity to collect feedback from End Users, you are typically the controller for Customer Content and Verity acts as a processor on your behalf.
  • • Verity is a controller for Account Data required to operate, secure, and bill for the Service (including security/rate limiting logs).

8.2 DPA and international transfers. Where required, we will provide a Data Processing Agreement ("DPA") covering our processor obligations (including subprocessors and international transfer mechanisms).

8.3 Security-related data. We may process technical and security data (such as IP address and user agent) for authentication sessions, abuse prevention, and rate limiting.

8.4 Local storage. The widget may use sessionStorage (or similar strictly necessary storage) to cache configuration responses for a short time-to-live. The widget does not use cookies by default.

The widget is not designed to perform device fingerprinting.

9. Integrations and third-party services

Integrations and webhooks may send Customer Content to third parties you choose. You are responsible for what data you send, having the rights and consents to send it, and your compliance with third-party terms and privacy requirements.

Third-party services operate independently and may change or fail. Verity is not responsible for third-party services outside our control.

10. Fees, plans, and payment

If you purchase a paid plan:

  • • Fees & taxes. You agree to pay all fees and applicable taxes. Fees are typically billed in advance on a recurring basis unless stated otherwise.
  • • Auto-renewal. Subscriptions renew automatically unless canceled before renewal.
  • • Payment processor. Payments may be handled by third parties (e.g., Stripe), and you agree to their terms.
  • • No overage billing. We do not currently charge overage fees. If you exceed plan limits, we may enforce limits by restricting functionality, pausing intake, or requiring an upgrade.
  • • Changes. We may change pricing, plan limits, or features. Changes generally take effect at renewal (unless required sooner for legal/security reasons).
  • • Refunds. Fees are non-refundable except where required by law or expressly stated in writing by us.

We may offer free plans or promotional trials from time to time, with the terms presented at sign-up or in-product.

11. Availability, support, and maintenance

We aim to keep the Service available, but we do not guarantee uninterrupted operation and we do not provide an SLA unless explicitly agreed in writing. Maintenance, outages, third-party failures, or enforcement of these Terms may affect availability. Asynchronous processing and rate limits may delay evidence processing or delivery.

12. Intellectual property

Verity and its licensors own all rights in the Service, including software, designs, branding, and documentation, except for Customer Content.

You may not copy, modify, reverse engineer, or resell the Service except where permitted by law or explicitly authorized by us in writing.

Feedback. If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.

13. Suspension and termination

13.1 By you. You may stop using the Service at any time. If you are on a paid plan, you may cancel your subscription through your account (or by contacting support if self-serve cancellation is unavailable).

13.2 By us. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service, customers, End Users, or third parties.

14. Data retention and deletion

Retention depends on your actions and plan, but generally:

  • • Active systems: after you delete Customer Content or cancel the Service, we delete Customer Content from active systems within up to 30 days (unless legally required to retain it longer).
  • • Logs: security and operational logs may be retained for up to 90 days.
  • • Backups: database backups may be retained for up to 30 days and may persist until overwritten or cycled out.
  • • Object storage:stored evidence objects may be retained for up to 30 days under retention policies; we do not maintain separate "backup copies" of object storage beyond standard storage retention/versioning behavior.

We may retain or de-identify data as needed to comply with legal obligations, resolve disputes, and enforce these Terms.

15. Confidentiality

Each party may receive the other party's non-public information. Each party will protect it using reasonable care and use it only to perform under these Terms. This does not apply to information that is public, independently developed, or lawfully obtained without obligation.

16. Indemnification

You agree to defend and indemnify Verity from third-party claims arising out of or related to Customer Content (including Evidence), your violation of law or these Terms, and your Integrations, webhooks, or configuration choices, to the extent the claim is caused by you.

17. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

18. Limitation of liability

To the maximum extent permitted by applicable law:

  • • Verity will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill.
  • • Verity's total liability for claims related to the Service is limited to the amount you paid for the Service in the three (3) months preceding the event giving rise to the claim (or zero if you are on a free plan).

19. Force majeure

Neither party is liable for failure or delay due to events beyond reasonable control (including outages, internet/provider failures, natural disasters, war, labor disputes, or government actions).

20. Changes to these Terms

We may update these Terms as the Service evolves. We will post the updated Terms and update the effective date. Material changes will be communicated by reasonable means (e.g., email or in-product notice).

21. Governing law and venue

These Terms are governed by Norwegian law, without regard to conflict-of-laws principles. Disputes will be handled by the competent courts in Norway.
